Terms & Conditions of this Licensing Agreement

1 Scope & Acceptance
These Terms and Conditions of this Licensing Agreement (hereinafter the “Terms”) apply to the use of the application under the name Tourism AI Playground and all associated services and add-ons including third party services provided through the application (collectively the “App” or “Services”) offered by Marketing Greece S.A. (hereinafter “we” or the “Company”, or “Marketing Greece”).
The App is intended to be used by business users, namely individuals that act on behalf of a business entity in Greece and lawfully represent it having the authority to bind such entity (the “User”).
The App is intended solely for internal business purposes for use by Users of tourism-sector (e.g., hotels, accommodations, travel agencies). For clarity, “internal business purposes” limits the User’s access to and use of the App/Services internally (prohibiting resale, sublicensing, white-labeling, or making the App/Services available to third parties as a service etc.). Output generated through the Services may be used and/or published by the User at the User’s sole risk and responsibility, subject to these Terms and applicable law.
Important Notice
Use by consumers and minors is prohibited. If the App is nevertheless used by consumers, any mandatory consumer rights apply only to the extent they cannot be lawfully excluded. All other disclaimers and limitations apply to the maximum extent permitted by the applicable law.
By accessing or using the Service, the User agrees to be bound by these Terms & Conditions. We strongly recommend carefully reading the Terms prior to the access and use of the Services.
By accepting the Terms, you warrant and represent that you have the legal capacity to do so and meet the requirements of the Terms (e.g. you are at least 18 years old) and you represent the legal entity on behalf of which you accept the Terms.
The Company reserves the right, at its sole discretion, to amend the Terms partially or in whole, from time to time and you are responsible for reviewing them periodically.
If you don’t agree with any of the Terms, please do not accept them. In such a case, our Company won’t be able to provide the Services.
All rights not expressly granted to you in the Terms are reserved by the Company.
The Service may rely on or integrate third-party services, APIs, and content sources (collectively “Third-Party Services”), and may include links to third-party websites or resources. The Company does not control Third-Party Services and makes no warranties and assumes no liability for Third-Party Services, including their availability, security, functionality, accuracy, legality, or any acts or omissions of third parties. The Company may change or discontinue Third-Party Services at any time.
2 Description of Services
The App provides free tools that may include (non-exhaustively) tools for image and text generation, interactive quiz generation, access to content library, review analysis, SEO performance, security scanning.
From time to time, we may add, make changes to or remove altogether functionalities of the Services or implement technical adjustments and improvements. These changes might affect your use of the Services. We may also decide to stop providing all or some of the Services at any time, and nothing in these Terms shall be taken as a guarantee that the Services will always be available, either in its current form or at any other form, or that We will support, maintain or continue to offer the Services. The Company has no obligation to provide any service levels, uptime commitments, support, or maintenance, unless expressly agreed in writing by the Company.
The Services use services by Third-Party Providers (e.g., AI providers, APIs, monitoring/analytics). Availability, performance, accuracy and functionality of such services depend on Third-Party Providers and may change or be discontinued without notice.
The User acknowledges that the App is an independent product of Marketing Greece and is not approved, sponsored, or in any way endorsed by third-party providers.
3 Output
The App provides some features that generate content (e.g., results, texts, images, recommendations) using artificial intelligence (“Outputs”).
EU AI Act Transparency Notice (Regulation (EU) 2024/1689)
The Company provides reasonable notices/labeling within the App so that the User understands that it interacts with an AI system through the Service, and certain Outputs and/or features may be AI-generated or AI-assisted. The User remains responsible for any further public-facing labeling/disclosure when publishing Output.
AI Content Warning
Outputs may contain errors, inaccuracies, omissions, outdated information, or “hallucinations” (plausible sounding but incorrect/fabricated content). The Company does not warrant Outputs are non-infringing or fit for commercial use without additional review/clearance.
You acknowledge and agree that:
- No Professional Advice: Outputs do not constitute legal, tax, financial, medical, cybersecurity or other professional advice. The User must apply human oversight before using/publishing Outputs.
- No High-Stakes Use: The User must not use Outputs for high-stakes or safety-critical decisions or activities that could cause harm.
- No Warranty: Outputs are provided “as is” without any warranty of accuracy, completeness, or fitness for a particular purpose.
- No Uniqueness Guarantee: The Company does not guarantee uniqueness of Outputs, and the User acknowledges and accepts that Outputs may be similar with Outputs produced for other users.
- IP/Originality Checks: Outputs may be similar to third-party materials. The User is responsible for non-infringement checks (copyright, trademarks, publicity rights), clearance, and accuracy of any attribution/sources.
Any output provided to a third party (other than the User) shall not constitute nor be construed as Output.
4 Intellectual Property
Platform Ownership: The App including any code, design, workflows, software, features etc. is owned by the Company and/or its licensors and is protected by IP laws (“Marketing Greece Content”).
License to Use: Subject to these Terms, the Company grants the User a limited, non-exclusive, non-transferable, revocable license to access and use the Marketing Greece Content solely for internal business purposes and no ownership rights are transferred to Users under the Terms.
User Content: The User retains all ownership rights in any content (e.g., text, URLs, domains, files, images, logos) that the User submits, uploads, inputs or makes available to the Services (“Input”) and owns all Output (collectively “User Content”). Subject to the underlying terms of Third-Party Providers and to the extent such Output is protectable under applicable law, Marketing Greece hereby assigns to the User all Company’s right, title, and interest, if any, in and to Output.
License Grant to Company: Marketing Greece shall use the User Content as necessary to provide the User with the Services, comply with applicable law, enforce the Terms, and prevent misuse. The User grants the Company (including its subsidiaries, affiliates and Third-Party Providers) a royalty-free, sublicensable, transferable, limited for the duration necessary to provide the Services, non-exclusive, worldwide license to host, reproduce, transmit, process, display, perform, modify, adapt, create derivative works from, and use the User Content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, to the extent necessary to provide, maintain and improve the Services (e.g., for security and troubleshooting incidents), comply with law, the Terms, as well as to enforce them and prevent misuse. Such license gives the right to the Company to disclose and sublicense User Content to Third-Party Providers strictly as necessary for the foregoing purposes (e.g., to process a request using an AI provider or API). The license lasts only for as long as reasonably necessary for the foregoing purposes, subject to any required retention for security, legal compliance, and dispute resolution.
User Representations: The User represents and warrants that (i) owns and controls all of the rights to the User Content that posts or otherwise distributes, or otherwise has the lawful right to post and distribute that User Content, to or through the Services and (ii) the granting of the aforementioned license of such User Content does not violate any rights of third parties, the Terms or any other terms or conditions or law applicable to the User.
Feedback: If the User provides any feedback regarding Services (e.g., questions, comments, suggestions, complaints) [“Feedback”], such Feedback shall be deemed the exclusive property of the Company, and the User hereby irrevocably transfers and assigns to the Company all intellectual property rights to the Feedback and waives any and all moral rights or economic rights that may have with respect thereto. User acknowledges and accepts that the use of Feedback will be made by the Company at its sole discretion.
AI Output & IP Notice
The User acknowledges and accepts that the Output is generated through artificial intelligence and does not meet the requirements for protection under intellectual property laws. The User represents and warrants that they will not attempt to register or protect the Output as an intellectual creation or intellectual property right in any public or private registry and assumes full responsibility for its use, acknowledging that the Company provides no warranty regarding the uniqueness or the legal protectability and registrability of the Output.
5 Users’ Obligations
Users shall use the Services — including the User Content — only in compliance with applicable law and these Terms.
Users shall not submit any personal data of Users or third parties, including special categories of data according to applicable law, unless they ensure that there is a legal basis for such processing (e.g., they have obtained the consent of the data subjects). This obligation applies to any confidential information of Users or third parties. In case that Users submit personal data into the Services, the Company will process such personal data under the Data Protection Agreement according to the applicable law.
Users shall submit only User Content that own or have permission to use within the App according to the applicable law.
When using features that interact with third-party services the Users shall comply with terms of the third-party providers of such services. In particular, for features utilizing Google services and content (including but not limited to Google Maps/Places API), the User expressly agrees to be bound by:
- (a) the Google Maps/Google Earth Additional Terms of Service, and
- (b) the Google Privacy Policy.
The User is prohibited from any use of Google services and content that violates such terms, including unauthorized caching, scraping, storage of reviews, or using such content for AI/machine learning model training.
Users shall review, verify and enforce human intervention to Output before use.
Prohibited Conduct
Users shall not, and will not permit other users to:
- Use the Services or the User Content in a way that violates the Terms and/or applicable law and/or third parties’ rights
- Allow minors to use the Services
- Reverse engineer any aspect of the Services or the systems used to provide the Services
- Use the Services and the User Content to develop products and services that compete with the Services of Marketing Greece, and/or its third-party providers, and/or its licensors (including, but not limited to, the development of AI systems and/or models)
- Access or use the Services via bots or other automated methods
- Extract data from the Services other than as permitted through the Services
- Buy, sell, or transfer API keys from, to, or with a third party
- Interfere with or disrupt the Services, including circumvent any rate limits or restrictions or bypass any protective measures or safety mitigations for the Services
- Violate or circumvent Usage Rules as provided in Section 7 or otherwise configure the Services to avoid such Usage Rules
- Submit, analyze, or use URLs or website source code for which they do not have the legal right, ownership and explicit authorization to access and analyze
- Remove, obscure, or alter any logos, trademarks, or proprietary notices (including attributions) of Marketing Greece and/or its third-party providers or licensors that appear in the Services
6 Liability
The App is provided free of charge, “as is” and “as available”, without warranty of any kind. Use of the Service is at the User’s own risk.
DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY THE APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AVAILABILITY, SECURITY, UNINTERRUPTED OR ERROR-FREE OPERATION.
Without limitation, the Company does not warrant that:
- the Services will meet the User’s specific requirements or achieve any particular results;
- the Services will be continuous, timely, secure, compatible, or error-free;
- any outputs, analyses, scores, scans, or other results will be accurate, complete, current, reliable, lawful, or suitable for any particular use;
- any defects will be corrected.
To the maximum extent permitted by the applicable law, in no event shall the Company or its affiliates, directors, officers, employees, contractors, licensors, or suppliers be liable for (i) any indirect, incidental, special, exemplary, or consequential damages, (ii) loss of profits, revenue, goodwill, reputation, business, customers, opportunities, anticipated savings, or business interruption, or (iii) loss, corruption, or unavailability of data, in each case arising out of or relating to the Services, Outputs, or these Terms, tort (including negligence), strict liability, or otherwise.
Nothing in these Terms excludes or limits any liability to the extent it cannot be lawfully excluded or limited (e.g., liability for willful misconduct/dolus).
The User uses Third-Party Services and third-party links at its own risk and is responsible for reviewing and complying with applicable third-party terms and policies.
User Liability & Indemnification
The User is solely responsible and liable for the User Content and represents and warrants that will keep the Company harmless from any claim of any third party arising out of or in connection with the User Content, including the use of the App by the User.
User will indemnify and will hold harmless the Company, its officers, employees, and contractors from any claims, damages, fines, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- (a) use of the App in breach of these Terms/law,
- (b) User Input,
- (c) the User’s publication/use of Outputs,
- (d) infringement of third-party rights,
- (e) the User’s non-compliance with deployer obligations (including end-recipient notices).
7 Usage Rules
The App shall not be used in any manner that violates applicable law and the Terms and/or infringes the rights of others, or conflicts with principles of safety, privacy, transparency, and human dignity.
Strictly Prohibited Uses
Without limitation, the following uses are strictly prohibited. The User agrees it will not (and will not allow others to):
Use the App in violation of law (e.g., using the App in a way that constitutes a prohibited practice under applicable law, including without limitation the EU AI Act), third-party rights, and/or these Terms.
Use the Application to create, promote, facilitate, or assist with:
- Threats, harassment, intimidation, or defamation
- Suicide, self-harm, eating disorders, or conduct likely to cause physical or psychological harm
- Sexual exploitation, sexual violence, or non-consensual intimate content
- Terrorism, extremism, or violence of any kind, including hate-based violence
- The development, acquisition, modification, or use of weapons, including conventional, chemical, biological, radiological, nuclear, or explosive materials
- Illegal goods, services, or activities
- Unauthorized access to, interference with, or destruction of systems, networks, data, intellectual property, or infrastructure
- Real-money gambling
- Circumvention of technical safeguards, monitoring mechanisms, or service limitations
- Military, intelligence, or national security uses without prior written approval
You may not use the Application to:
- Collect, aggregate, monitor, profile, or distribute personal data
- Build or expand facial recognition databases
- Conduct real-time remote biometric identification in publicly accessible spaces
- Reproduce or simulate a person’s likeness (including voice or photorealistic image) without consent in a way that could mislead others
- Engage in social scoring, behavioral profiling, or classification based on personal characteristics, biometric data, or inferred sensitive attributes
- Infer emotional states in workplace or educational environments, except where strictly necessary for medical or safety purposes
- Predict criminal behavior solely based on profiling or personal traits
Child Protection
Minor Protection
The App must never be used to exploit, harm, or endanger individuals under 18 years of age.
Prohibited activities include indicatively:
- Creation, possession, or distribution of child sexual abuse material, whether authentic or synthetic
- Grooming or solicitation of minors
- Exposure of minors to explicit sexual content, graphic violence, or harmful self-harm content
- Promotion of unhealthy dieting, extreme exercise, body shaming, or stigmatization of minors
- Encouraging dangerous challenges or underage participation in restricted activities
- Sexual or violent roleplay involving minors
Additional Prohibitions
You may not use the Application to:
- Engage in academic dishonesty
- Commit fraud, scams, impersonation, spam, or deceptive practices
- Interfere with elections, political campaigns, lobbying, or civic participation
- Automate or substantially assist high-stakes decision-making without meaningful human oversight in areas including but not limited to:
- Healthcare and medical services
- Legal services
- Financial services, credit, insurance, or investments
- Employment and workplace decisions
- Housing access
- Education access or evaluation
- Essential government services
- Law enforcement or migration decisions
- Critical infrastructure or product safety systems
The Services and the User Content shall not be used as a substitute for professional advice without appropriate review and involvement of a qualified professional.
Prohibited Input & Technical Conduct
It is prohibited for the User to:
- Submit Input that:
- (a) contains third-party personal data without lawful basis/notice where required,
- (b) infringes IP, trademarks, or confidentiality,
- (c) is unlawful, defamatory, harmful, racist, hateful, or incites violence/hate,
- (d) contains malware or seeks to disrupt/bypass the App’s security.
- Reverse engineer, decompile, perform prompt extraction, scrape/harvest the App, or systematically extract Outputs to build competing services
- Circumvent rate limits, technical restrictions, or security measures
- Use Outputs as the sole basis for business actions and decisions (e.g., vulnerability remediation) without suitable professional review and human intervention
8 Termination
The Company may, in its reasonable discretion, restrict, suspend, or terminate access at any time, with or without notice, especially where:
- breach of Terms/law/third-party terms is suspected,
- required for security/compliance/abuse prevention, or
- required by authorities or third-party providers.
9 Miscellaneous
No Waiver: Any delay of the Company in exercising any of its rights under this agreement or provided by law, shall not be deemed as waiver of any kind, as the Company may exercise its rights at a later stage.
Notice & Takedown
If you believe content associated with the App infringes rights (e.g., IP) or is unlawful, you may submit a notice to admin@marketinggreece.com including:
- (a) contact details,
- (b) identification/description of the material,
- (c) the right allegedly infringed and supporting evidence,
- (d) good-faith statement,
- (e) accuracy statement.
The Company may remove/disable access to the material and/or suspend related use. The User may submit a counter-notice with supporting information. The Company may act in accordance with law, including reporting to competent authorities.
Amendments
The Company may amend these Terms. Changes take effect upon posting in the App or on another stated effective date. Continued use after the effective date constitutes acceptance.
Governing Law & Jurisdiction
These Terms are governed by Greek law. The courts of Athens (Greece) shall have exclusive jurisdiction for any court proceeding (including interim measures).
Severability
If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.
